Judge Berman has specialised in criminal law for most of his time as a lawyer. He spent seven years as a trial lawyer before two years as a law reformer and then nine years as an appellate lawyer appearing in the Court of Criminal Appeal, Court of Appeal and High Court both as a prosecutor and public defender. He has taught Advocacy with the Australian Advocacy Institute since 1985; and has taught at workshops in all states and territories of Australian as well as Singapore and Hong Kong. Judge Berman was called to the NSW Bar in 1986, appointed Senior Counsel in 2000, and sworn in as a Judge of NSW District Court in 2002. In 2004 he was a member of the Advisory Committee which assisted in the review of the Evidence Act conducted jointly by the ALRC, NSWLRC and VLRC, and in 2009 he chaired the Child Pornography Working Group, which was asked by the NSW Attorney General to examine a number of issues regarding offences relating to child pornography.
